Munchly Terms of Use

Welcome to Munchly! These Terms of Use ("Terms") govern your use of the Munchly website (https://munchly.me) and its services, including but not limited to creating products, recipes, meal plans, and accessing nutritional information. By accessing or using Munchly, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the service.

1. User Responsibilities

  • 1.1 Content Responsibility

    You are solely responsible for the content you create, upload, or share on Munchly, including recipes, meal plans, and any other materials. You agree not to upload, post, or share any content that is illegal, offensive, harmful, or violates the rights of others. Munchly reserves the right to remove any content that violates these Terms without prior notice.

  • 1.2 Access to Content

    Even if your subscription expires, you will retain access to your recipes. However, access to premium features such as meal plans and nutritional facts will be limited.

  • 1.3 Sharing Content

    You may share your recipes with others through the Munchly platform. In the future, sharing meal plans may also be permitted. By sharing content, you grant Munchly a non-exclusive, worldwide, royalty-free license to display and distribute your content through the platform.

2. Subscription Details

  • 2.1 Free Trial

    New users receive a two-week free trial of Munchly’s premium features. After the trial period ends, users must purchase a subscription to continue accessing premium features.

  • 2.2 Subscription Purchase

    Subscriptions are purchased through the Munchly website (https://munchly.me) using Stripe as the payment gateway. The current subscription fee is $3 per month, but this price may change at any time.

  • 2.3 Subscription Limitations

    If you do not purchase a subscription after the trial period, your access to premium features (e.g., meal plans and nutritional facts) will be limited. However, you will still be able to view, share, and delete your recipes.

  • 2.4 Cancellation

    You may cancel your subscription at any time through your Account Settings page (https://munchly.me/user/account). Upon cancellation, your subscription will remain active until the end of the current billing period. After expiration, you will not be charged, and your access to premium features will be limited.

  • 2.5 No Refunds

    All subscription payments are non-refundable.

3. Payment Processing

Munchly uses Stripe to process payments. We store subscription activation and expiration dates but do not store credit card numbers, bank account information, or other sensitive payment details.

4. Data Privacy

  • 4.1 Data Collection

    We collect only your email and name during registration. Sensitive data, such as passwords, is encrypted for security.

  • 4.2 Data Sharing

    We do not share your personal data with third parties.

5. Intellectual Property

All content created on Munchly, including recipes, meal plans, and other materials, is owned by Munchly. However, you retain the right to access, edit, delete, and share your content as permitted by the platform’s functionality.

6. Liability and Disclaimers

  • 6.1 Nutritional Information

    Nutritional information provided by Munchly is based on the products and data you input into the platform. We use information from the USDA FoodData Central (https://fdc.nal.usda.gov) to calculate nutritional values.   • 6.2 Professional Advice

    Munchly is not a substitute for professional medical or dietary advice. You are responsible for consulting a qualified professional (e.g., dietitian, doctor) before relying on any meal plans or nutritional data provided by Munchly.

  • 6.3 Limitation of Liability

    Munchly is not liable for any damages arising from your use of the service, including but not limited to indirect, incidental, or consequential damages.

7. Termination of Accounts

Munchly reserves the right to terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason. Upon termination, all your data will be permanently deleted.

8. Governing Law

These Terms are governed by the laws of Poland. Any disputes arising from your use of Munchly will be resolved in accordance with Polish law. If you are a user located outside Poland, you agree to submit to the jurisdiction of Polish courts.

9. Updates to Terms

Munchly may update these Terms at any time. The most current version will always be available on this page. By continuing to use the service, you agree to the updated Terms. Munchly is not obligated to notify you of changes, but we may do so at our discretion.

10. Third-Party Services

Munchly uses nutritional data from the USDA FoodData Central (https://fdc.nal.usda.gov). By using Munchly, you acknowledge and agree to the terms and conditions of any third-party services integrated into the platform.

11. Age Restrictions

Munchly is restricted to users who are 18 years of age or older. By registering for an account, you confirm that you meet this age requirement.
